BUSTED!
Long Beach Alamitos Peninsula home owners have been building out over their property lines onto state owned land for quite some time now. Violations include a single step to a patio extending nearly 50 feet, infringing on public coastal areas owned by the state. According to a 2003 land survey commissioned by the Parks and Recreation Department 31 homes on the Long Beach Peninsula are encroaching onto public beaches in violation of the California Coastal Act. Apparently the report was quietly buried. Gee, I wonder how that happened?
The Long Beach Peninsula is home to our former Mayor Beverly O'Neill and former City Coucilman Frank Colonna. The District doesn't think Frank Colonna is taking this all too seriously, they quote Colonna as saying http://www.longbeachrealestatehome.com/000D75 Posted on August 22, 2007 17:28:04 by Laurie.Manny
Comment from: Sunriver Real Estate | Thesa Chambers, Broker [Visitor] Wow, sounds like a huge issue for those that enjoy the area and live on one of these properties.... educating the buyer will be important on this. Great job in bringing it to the attention of the public Laurie Comment from: Laurie.Manny [Member] Hi Thesa, I read the article over at The District and thought "My God, what brass"! I showed several multi-million dollar properties on the Peninsula this week. One of the main features my buyers were interested in was a large beachfront deck so that he had a place to smoke his cigars. Can you just imagine finding out the deck had to go after the close of escrow? Can you say nightmare? Comment from: Mary Pope-Handy [Visitor] This is incredible! My town, Los Gatos, is not beachfront, but I cannot imagine this happening in Santa Cruz, Capitola, or any of our nearby waterfront communities. I'm amazed that the public hasn't screamed bloody murder. Great post, Laurie. Very eye-opening! Sounds like buyers have a lot to be concerned about, and sellers have much to fear.... Comment from: Laurie.Manny [Member] Hi Mary, I agree, buyers will need to proceed with caution and understand the responsibility and potential liability. I don't think that sellers have much to fear, they just have to understand that they will have to make this right. Comment from: Sharon Simms [Visitor] In Florida along the Gulf of Mexico it's the sellers responsibility to provide the buyer with a survey showing the Coastal Construction Line which should definitely show any encroachments. Comment from: Laurie.Manny [Member] Sharon, That is interesting, how do they go about doing that? Do they rely on Title? Or an actual survey? Comment from: Kaye Thomas [Visitor] Shades of Malibu.. will be interesting to see if they actually do anything about the problem Comment from: Laurie.Manny [Member] Kaye, My thoughts precisely.
